Neutral Citation No. - 2025:AHC:125860 Court No. - 4 Case :- WRIT - A No. - 10535 of 2025 Petitioner :- Rajveer Singh Respondent :- State Of Uttar Pradesh And 2 Others Counsel for Petitioner :- Ram Mangal Singh,Sr. Advocate Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J. Heard Sri Ashok Khare, learned Senior Advocate assisted by Sri Ram Mangal Singh, learned counsel for the petitioner as well as learned Standing Counsel. By means of this petition filed under Article 226 of the Constitution, petitioner has prayed for quashing of the order dated 15.07.2025, whereby, he has been transferred from Moradabad to Kushinagar. The submission advanced by learned counsel for the petitioner is that after the petitioner came to be promoted from the post of Chakbandi Lekhpal to Coordinator, he was given posting at adjoining district Moradabad as he was at that particular point of time was posted at Amroha but now he has been transferred to district Kushinagar which is quite far away as wife of the petitioner continues to remain posted at Meerut. It is therefore, contended that in view of the transfer policy petitioner's request for transfer in a nearby district or Meerut should have been considered in the first instance. Per contra it is argued by learned Additional Chief Standing Counsel that petitioner's wife is an Assistant Teacher in a school run by Basic Shiksha Parishad and therefore, she would continue to remain posted at Meerut and petitioner cannot claim to be retained at Meerut or be always posted in nearby district as he is working on a transferable post and therefore, he can be transferred anywhere in administrative exigency. However, he is not averse to the petitioner's representation accorded due consideration, if made. In view of the above, while I decline to interfere in the order of transfer at this stage, I hereby provide that in the event petitioner makes a representation within two weeks along with the certified copy of this order before the competent authority namely the Consolidation Officer, U.P., the same shall be considered and
disposed of within a further period of two weeks considering the relevant provisions contained in the transfer policy dated
06.05.2025. With the aforesaid observations and directions, this petition stands
disposed of.
