The present Habeas Corpus Writ Petition has been filed with a prayer to issue a writ, order or direction in the nature of Habeas Corpus commanding the respondents to produce the corpus namely Roshini (Minor), D/o Kamta, R/o Gram Semri, Post Semri, P.S. Thana Kotwali Nagar, Banda before this Hon'ble Court within a specified time period and she may be released in favour of her legal/natural guardian/father (petitioner). It has been submitted by learned counsel for the petitioner that Roshini (corpus) is his minor daughter and has been illegally detained by Respondent no. 4, Prashant Kushwaha. As per the instructions received by learned AGA, the corpus has been housed at Rajkiya Bal Grih (Balika), Swaroop Nagar, Kanpur Nagar, Unit-1. As the corpus is presently housed at Rajkiya Bal Grih (Balika), Swaroop Nagar, Kanpur Nagar, Unit-1, the petitioner may seek appropriate remedy for the custody of the corpus.
