Neutral Citation No. - 2025:AHC:130336 Court No. - 4 Case :- WRIT - A No. - 10577 of 2025 Petitioner :- Deen Dayal Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Jay Singh Yadav Counsel for Respondent :- Bhupendra Kumar Tripathi,C.S.C. Hon'ble Ajit Kumar,J. 1. Heard learned counsel for the parties. 2. Petitioner approached this Court for a writ of certiorari to question the notification issued by the respondents to make selection and appointment on the post of Accountant/Date Entry Operator on the ground that he has been discharging duties on the said post. 3. Learned Standing Counsel has obtained instruction and as per instructions, petitioner was appointed for a period of one year which came to end on 10.04.2023 and upon expiry of period no further renewal was granted to the petitioner and the Gram Panchayat accordingly proceeded to pass resolution on 20.06.2025 to hold fresh selection for the post in question. It is further contended that the said resolution has never been challenged inasmuch as pursuant to notification issued new selection has taken place and the person duly selected has been given appointment and the same has been sent for approval to district authorities concerned. 4. In the given facts and circumstances when the petitioner's renewal on the post of Accountant/Date Entry Operator has not come to be renewed after 2023, nor there is any document appended to the petition in that behalf and in the face of the fact that the Gaon Sabha has adopted resolution to make fresh appointment and selection and pursuant to which notification was issued and the selection was held, no relief as such prayed for the selection can be granted. 5. Writ petition fails and is accordingly, dismissed. 6. In so far as the petitioner's claim for unpaid remuneration for the period he has discharged duties as Panchayat Sahayak/Data Entry Operation is concerned, if he makes a representation, the same shall be looked into and decided by the competent authority in accordance with law. 7. In view of the above, this petition stands disposed of with direction to the petitioner to make representation regarding his claim within a period of four weeks from today before the competent authority which shall be looked into and considered and shall also be decided as expeditiously as possible preferably within a further period of one month.
