Though the present petition has been filed for restoring an application bearing Cr. Misc. No.81360 of 2019, filed for quashing of the order taking cognizance dated 08.12.2000, passed by the Ld. Court of Additional Chief Judicial Magistrate, Birpur (Supaul), in Complaint Case No.278(C) of 1997, which has stood dismissed for default on account of non-compliance of the peremptory order dated 13.01.2020, however, at the outset, the Ld. Counsel for the petitioner submits that on account of the aforesaid petition having been dismissed for default on a number of occasions, much time has elapsed during the interregnum period, hence in case lis so survives, the petitioner be granted liberty to take recourse to the due process of law for assailing the order taking cognizance dated 08.12.2000, as aforesaid.
