Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents 1, 2 and 6. Though notice has been served on the respondents 3, 5 & 7 and their names are printed in the cause list, none appeared either in person or through pleader on their behalf. Perused the materials available on record. 3. The petitioner is holding a bank account with the seventh respondent bearing Account No.0486360000000143. It is the case of the petitioner that the seventh respondent received an e-mail dated 25.07.2024 from the third respondent stating that a case has been registered in Crime No.1534 of 2024 for the offences under Sections 94 and 106 of Bharatiya Nyaya Sanhita, 2023, in respect of online financial fraud. Thereafter, no communication was received from the third respondent either directing the seventh respondent to continue the lien over the petitioner’s bank account or to defreeze the same. Further, the e-mail sent by the third respondent does not disclose whether the petitioner has been arrayed as an accused or not in the said crime. https://www.mhc.tn.gov.in/judis WP Crl. No. 1469 of 2025 __________ Page4 of 5 4. In view of the above, the seventh respondent is directed to defreeze the petitioner’s account and permit the petitioner to operate the account forthwith. It is made clear that, if any further communication received from the Cyber Crime Wing with regard to the petitioner’s bank account, the seventh respondent shall act in accordance with law. 5. With the above direction, this Writ Petition (Criminal) stands disposed of.
