Present application preferred under Section 528 of B.N.S.S., 2023 is supported with the compounding application and the same is also supported with the affidavits of applicants well as respondent. 4. Applicants-Narendra Mittal and Anil Kumar as well as respondent-Col. (Retd.) Sanjiv Alipuria are present in the Court. They are duly identified by their respective counsel. 5. By means of this C528 application applicants have sought quashing of the summoning order dated 14.10.2024 as well as the entire proceedings of Complaint Case No.3528 of 2022, Col. (Retd.) Sanjiv Alipuria vs. Narendra Mittal & others for the offence punishable under Sections 420, 467, 468, 471 and 120-B of IPC registered at P.S. Clement Town, District Dehradun pending in the court of IInd Additional Chief Judicial Magistrate, Dehradun. 6. A compounding application has been moved alongwith a Joint Compromise wherein it is stated that the dispute has been amicably settled between the parties and both the parties have buried their differences and now they do not have any grievance against each other and in future they want to live peacefully. 7. Learned counsel for the parties submits that since the dispute between the parties has been settled and both the parties have come into the terms of settlement thus the proceedings of the present case may be quashed. 8. Since the dispute between the parties has been resolved and parties have come into the terms of compromise, in such an eventuality continuation of the proceeding in the present matter will be a futile exercise. 9. In view of the aforesaid, the compounding application is allowed. Entire proceedings of Complaint Case No.3528 of 2022 Col. (Retd.) Sanjiv Alipuria vs. Narendra Mittal & others for the offence punishable under Sections 420, 467, 468, 471 and 120-B of IPC registered at P.S. Clement Town, pending in the court of IInd Additional Chief Judicial Magistrate, Dehradun are quashed. 10. Accordingly, C528 application stands disposed of.
