HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. BAIL APPLICATION No. - 26130 of 2025 Court No. - 67 HON'BLE KRISHAN PAHAL, J. 1. List has been revised. 2. Heard Sri Akash Dwivedi, learned counsel for applicant as well as Sri Anit Kumar Shukla, learned A.G.A. for the State and perused the material placed on record. 3. The present bail application has been filed by the applicant in Case Crime No.32 of 2025, under Sections 115(2), 351(3), 352, 109 B.N.S. and Section 4/25 Arms Act, Police Station- Kaptanganj, District- Azamgarh with the prayer to enlarge him on bail. 4. As per prosecution story, talks were going on between the family of the informant and applicant regarding marriage of his daughter but the matter could not be materialized and the said talks were called off. On 8.2.2025 at about 08:00 a.m., the applicant is stated to have barged into the house of informant armed with knife and had assaulted the daughter of the informant causing grievous injuries to her neck and other parts of the body. 5. It is further alleged that when the wife of the informant rushed to save her daughter, she was also assaulted by the applicant. The informant called at 1090 number and the public at large caught hold of the applicant at the spot and had beaten him up. The applicant and victim were admitted in hospital. 6. Learned counsel for the applicant has stated that the applicant has been falsely implicated in the present case. The marriage between applicant and Versus Counsel for Applicant(s) : Akash Dwivedi, Vikas Dwivedi Counsel for Opposite Party(s) : G.A. Rovin Singh .....Applicant(s) State of U.P. .....Opposite Party(s) daughter of the informant was to be solemnized and he was called by the said daughter only. The injuries sustained by the victim are simple in nature. The injuries sustained by the applicant have not been explained by the prosecution. As such, the applicant is entitled for bail. 7. It is further argued by learned counsel for the applicant that there is no criminal history of the applicant. The applicant is in jail since 8.2.2025 and he is ready to cooperate with trial. In case, the applicant is released on bail, he will not misuse the liberty of bail. 8. Per contra, learned A.G.A. has vehemently opposed the bail application on the ground that the offence stands admitted by the applicant as he was apprehended at the spot and the injuries of the applicant also stand explained as it is stated in the FIR and subsequently in the statement of injured person that public at large had caught hold of the applicant and beaten him up, as such, the injuries sustained were caused by the neighbours of the informant. 9. After hearing learned counsel for the parties, taking into consideration the injuries sustained by the daughter of the informant coupled with the fact that admittedly the applicant sustained injuries in the incident, I do not find it a fit case for grant of bail to the applicant. 10. The bail application is found devoid of merits and is, accordingly, rejected. 11. However, it is directed that the aforesaid case pending before the trial court be decided expeditiously in view of the principle as has been laid down in the recent judgments of the Supreme Court in the cases of Vinod Kumar vs. State of Punjab; 2015 (3) SCC 220 and Hussain and Another vs. Union of India; (2017) 5 SCC 702, if there is no legal impediment. 12. It is clarified that the observations made herein are limited to the facts brought in by the parties pertaining to the disposal of bail application and the said observations shall have no bearing on the merits of the case during trial.
