This petition has been filed to set aside the order dated 09.01.2025 passed in C.M.A.No.2005 of 2023, dismissing the Appeal for non-prosecution, and to restore the Appeal. 2.The appellant/petitioner states that his counsel was facing health issues at the time when the Appeal was listed before the Court for hearing. Learned counsel for the petitioner states that now he is ready to argue the matter on merits. Learned counsel appearing for the respondents 1 to 3 have no serious objections for allowing this petition. 3.Being satisfied with the reasons stated in the affidavit filed in support of the petition, in order to give one more opportunity, this petition is ordered and the order, dated 09.01.2025, made in C.M.A.No.2005 of 2023, is set aside and the Appeal is restored to file. 4.Post the Appeal in C.M.A.No.2005 of 2023 for final hearing on 28.07.2026.
