Respondent(s) For Petitioner : Mr. Ajay Chandra, Advocate For State : Mr. Prateek Tiwari, P.L. 2 Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 17-07-2025 1) By way of this petition, petitioner has sought following reliefs:- (i) That, the Hon'ble Court may kindly be pleased to set-aside the impugned order dated 08.01.2021 (Annexure P-1) passed by the respondent no. 3 or to give direction to the respondent authorities to issue new inviting application for allotment of the fair price shop at gram panchayat Bade Rabeli, block Malkharouda, District Janjgir Champa, in the interest of justice. (ii) That, the Hon'ble Court may kindly be pleased to direct the concern respondent authorities to enquire the matter in subject of irregularities committed by the respondent no. 5's society at gram panchayat Bade Rabeli, block Malkharouda, District Janjgir Champa, in the interest of justice. (iii) Any other relief which may be suitable in the facts and circumstances of the case, may also be granted. 2) Learned counsel for the petitioner submits that respondent No. 5- group is not running the Fair Price Shop allotted to it properly. He further submits that several complaints were made before respondent authorities but no action has been taken. He prays that a direction may be issued to respondent authorities to decide the pending representations. 3) On the other hand, learned State counsel opposes. 4) Heard. 3 5) It appears that complaints were made by the petitioner and same were considered by SDO(R), Sakti. The authority concerned found the allegations baseless and rejected the complaint. In the present petition, petitioner has not placed relevant documents to prove misappropriation of foodgrains. If the petitioner is aggrieved by the order passed by SDO(R), Sakti, he may avail the appropriate legal remedy available to him. 6) Consequently, this petition being bereft of material facts and substance, stands dismissed.
