Vide order dated 19.01.2019 passed by the District Supply Officer, Meerut/ Respondent No. 3, the Fair Price Shop License of the petitioner was cancelled. 2. Aggrieved against the aforesaid, statutory appeal as provided under Section 13(1) of the U.P. Essential Commodities (Regulation of Sale and Distribution Control) Order (2016) was filed by the petitioner before the Respondent No. 2, Deputy Commissioner Food and Civil Supply Meerut Division, Meerut which was numbered as Case No. 00158 of 2020. The aforesaid appeal was dismissed for want of prosecution on 03.05.2024. 3. Aggrieved against the aforesaid, the petitioner has preferred the present writ petition. 4. It is argued by the learned Standing Counsel appearing on behalf of Respondents that in case the appeal filed by the petitioner was dismissed for the want of prosecution, he is a remedy to file a recall application before the same authority to recall the aforesaid order. Hence, the present writ petition is not maintainable. 5. Heard counsel for the parties and perused the record. 6. In the facts and circumstances of the case and also in the interest of justice, the present writ petition is disposed of finally permitting the petitioner to file a recall application before the Respondent No. 2, Deputy Commissioner Food and Civil Supply Meerut Division, Meerut to recall the order dated 03.05.2024. In case such application is filed within a period of three weeks' from today, he will pass appropriate order on the same, expeditiously and preferably within a period of four weeks thereafter.
