(Oral) Petitioner herein, who has completed normal tenure of posting at present place of posting i.e. Government Middle School Baghar U/C Government Senior Secondary School Dhabas, Tehsil Chopal, District Shimla, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide the pending representation, whereby prayer has been made to transfer him to some other station. 2. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. Vishal Panwar, learned Additional Advocate General. While
accepting notice on behalf of the respondents, Mr. Vishal Panwar, learned Additional Advocate General, fairly states that representation (Annexure P-2) filed by the petitioner, if not already decided, shall be decided expeditiously. 3. Careful perusal of averments contained in the petition, which are duly supported with an affidavit as well as documents annexed therewith, this Court finds that since petitioner, who is working as TGT (Non Medical) at Government Middle School Baghar U/C Government Senior Secondary School Dhabas, Tehsil Chopal, District Shimla, has completed normal tenure of posting at present place of posting in the month of November, 2021, coupled with the fact that as per Clause 10.1 of the Transfer Policy, normal tenure of posting at one station has been prescribed as three years, this Court sees no impediment in accepting the innocuous prayer made on behalf of the petitioner to issue direction to the respondents to consider and decide the representation of the petitioner. 3. Consequently, in view of the above, present petition is disposed of with a direction to the respondents to consider and decide the representation of the petitioner (Annexure P-2), expeditiously, preferably within a period of four weeks.
Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass 2
