In verification of their death, statement of Badam Singh, brother of appellant no.1 and son of appellant no.2 has been recorded. Statement of Gram Pradhan Harish Chand, Gram Panchayat Mahlai, Block Badhpur, District Farrukhabad has also been recorded. Police Report of S.I. Deepak Kumar of Police Station Mau Darwaza, District Farrukhabad has been annexed. 4. Learned AGA could not dispute the aforesaid facts. 5. In view of the above, since both the appellants had already passed away, the instant criminal appeal is dismissed as having been abated. 6.
