JUSTICE ANANT RAMANATH HEGDE ORAL ORDER This petition is filed assailing the concurrent finding in respect of offence under Section 138 of the Negotiable Instruments Act, 1881 (for short, 'Act, 1881'). Petitioner before this Court is convicted to pay fine of Rs.5,30,000/- to the complainant for dishonour of cheque of Rs.5,00,000/-. 2. Learned counsel for the petitioner and the respondent jointly submit that the dispute is amicably settled. 3. A joint memo is also filed incorporating the terms and conditions of the settlement. The joint memo is signed by the learned counsel for the petitioner and the learned counsel for the respondent and also the petitioner and the respondent. 4. The petitioner/accused has agreed to pay the complainant Rs.4.00 lakhs in three instalments as incorporated in the joint memo. It is also recited in the joint memo that in case the accused/petitioner fails to pay the instalments, the orders of conviction rendered by the Trial Court and confirmed by the Appellate Court stand revived. - 3 - HC-KAR NC: 2025:KHC:35777 CRL.RP No. 1113 of 2024 5. The complainant who is present before the Court submits that he has voluntarily agreed for the settlement and agreed to receive Rs.4.00 lakhs towards discharge of the full claim against the petitioner. 6. It is submitted that the complainant has received Rs.80,000/- out of which Rs.40,000/- by way of cash and Rs.40,000/- through electronic transfer. 7. This Court does not find any impediment to accept the terms of settlement. 8. Hence the following: ORDER (i) Criminal Revision Petition is disposed of. (ii) The impugned judgments dated 29.06.2024 passed by the Additional Sessions Judge, Mysuru in Crl.A.432/2023 confirming the sentence and conviction dated 16.11.2023 passed by the JMFC, Mysuru in C.C.No.3129/2016 are set- aside. (iii) Accused is acquitted of the charges.
