KINAGI) This contempt petition is arising out the order passed in Writ Petition No.104211/2024 dated 01.08.2024 wherein the learned Single Judge directed the respondent to complete the process of promotion initiated in respect of post of Assistant Professor (AGP at Rs.8,000/-) and Associate - 3 - NC: 2025:KHC-D:871-DB CCC No. 100346 of 2024 Professor (AGP Rs.9,000/-) as expeditiously as possible within an outer limit of three months in accordance with law. 2. After disposal of the said writ petition, the complainants submitted a representation to the Registrar, University of Agricultural Sciences, Dharwad, vide representations dated 29.10.2024 requesting to implement the order passed by the learned Single Judge in the aforesaid writ petition and also submitted several representation vide Annexures-B, B1 to B3. Despite giving several representations, the respondent did not comply the order passed by the learned Single Judge. Hence, this contempt petition. 3. Heard the learned counsel for the complainants and respondent No.2. 4. Learned counsel for the respondent No.2 submits that pursuant to the order passed by the learned Single Judge, the respondent No.2 has considered the grievance of the complainants vide order dated 28.12.2024 which reads as under: - 4 - NC: 2025:KHC-D:871-DB CCC No. 100346 of 2024 “ The Vice-Chancellor, University of Agricultural Sciences, Dharwad is pleased to appoint by promotion the Teachers indicated in Annexure-I to the respective grades / cadres under Career Advancement Scheme - 2006 with effect from the dates as shown against their names. This promotion order is subject to the final orders / outcome in W.P.No.105854/2024 (S- RES) pending before the Hon'ble High Court of Karnataka, Dharwad Bench and shall also be subject to the concurrence and approval of the Department of Finance and Department of Agriculture, Government of Karnataka. The promoted teachers shall submit an undertaking in the prescribed proforma attached as Annexure -II to this order, at the time of submitting their deemed reporting letter for the promoted grade / cadre to the concerned reporting officers. Accordingly, the concerned reporting officers should obtain the undertaking from the concerned teachers and submit the same to the Registrar, UAS, Dharwad. The post held by the incumbent / the post on which the Teacher is shown or posted is upgraded and is treated as personal to the incumbent holding it. As soon as the Teacher retires / vacates the post, the respective post will retain its original status. The promotions to various grades / cadres under CAS- 2006 being personal promotions, but are not against the sanctioned posts. The teaching / research / extension work- - 5 - NC: 2025:KHC-D:871-DB CCC No. 100346 of 2024 load of the Teachers shall be carried with them and shall be undertaken by the promotees even in the upgraded capacity. 5. Respondent No.2 has complied the directions issued by the learned Single Judge. The said fact is not disputed by the learned counsel for the complainants. 6. As respondent No.2 has complied the directions issued by the learned Single Judge, nothing survives for consideration in this contempt. Accordingly, contempt petition is dropped.
