Tejaswini K., for Sri B.M.Siddappa, learned counsel for the petitioner. The petition under Section 24 of the CPC filed by the wife with the following prayer: "THEREFORE, it is most respectfully prayed that this Hon'ble Court may be pleased to withdraw the M.C.No.223/2025 pending on the file of the Principle Judge Family Court, Vijayapura and transfer the same to the Senior Civil Judge court at Chitradura, by allowing this petition in the interest of justice and equity." 2. Facts in the nutshell, which are utmost necessary for disposal of the present petition, are as under: - 3 - HC-KAR NC: 2025:KHC:49968 CP No. 368 of 2025 On account of the strained relationship between the petitioner and the respondent, a petition for divorce came to be filed by the respondent against the petitioner on the file of Prl. Judge Family Court, Vijayapura. 3. The wife is now residing in the parental house at Chitradurga and therefore she has sought for the transfer of the said matrimonial proceedings to the court at Chitradurga on account of geographical distance and financial implications. 4. None appears for the respondent. 5. Having heard the arguments of Smt. Tejaswini for B.M.Siddappa, this court perused the material on record meticulously. 6. Having noted that geographical distance and financial constraints are no longer valid parameters to transfer a pending case from one court to another court in - 4 - HC-KAR NC: 2025:KHC:49968 CP No. 368 of 2025 view of the video conferencing facility, the petition needs to be dismissed. 7. The petitioner can effectively appear before the court at Vijayapura from Chitradurga through video conferencing and effectively participate in the matrimonial proceedings. 8. If the wife files an application before the court at Vijayapura seeking permission to appear through video conferencing, the learned Trial Judge, Family Court, Vijayapura shall permit the wife to appear through video conferencing. 9.
