The present appeal has been preferred against the judgment and order dated 21.09.2024 passed by the learned Civil Judge (Senior Division), Nainital in Civil Suit No. 06 of 2016 “Smt. Neena Khan vs. Jitendra Singh and another”, whereby the appellant/plaintiff was directed to pay the court fee on the market value of the property. 4. Learned counsel for the respondents would submit that the present appeal has rendered infructuous inasmuch as Civil Suit No. 06 of 2016 itself has been dismissed by the learned Civil Judge (Senior Division), Nainital vide judgment and order dated 20.08.2025. In support of his submission, he has produced a copy of the said judgment before this Court. 5. The copy of the judgment and order dated 20.08.2025 passed in Civil Suit No. 06 of 2016 is taken on record. The Registry is directed to paginate the same as per the record. 6.
