Neutral Citation No. - 2025:AHC:13200-DB Court No. - 29 Case :- WRIT - C No. - 2977 of 2021 Petitioner :- Vindhyachal Singh Yadav And 7 Others Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Kamlesh Kumar Yadav,Subhash Singh Yadav Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Petitioners claim to be folk artists, who allegedly have performed at various occasions on the instructions of the respondent-State. It is submitted that honorarium due and payable to the petitioners in terms of the State scheme has been denied to them. Taking cognizance in the matter, this Court had passed following orders on 3.2.2021:-
“Learned Standing Counsel shall seek instructions whether the petitioners, who are seeking payment for folk dance performance to promote Swachha Bharat Mission, were given orders for such performance on promise of remuneration or not and whether they have performed as per the promise and remuneration, as promised, has been paid to them or not. Instructions be obtained within two weeks. List on 25th February, 2021.” Subsequently an affidavit has been filed by the District Magistrate stating that in the inquiry conducted in the matter by the Swachha Bharat Mission (Rural) the amount has not been found due and payable.
Learned counsel for the petitioner states that petitioners are folk artists and they have neither been heard nor the certificates of their performance have been taken note of and, therefore, the report is not reliable. Considering the fact that petitioners are folk artists, we deem it appropriate to permit them to approach the third respondent, once again, alongwith a certified copy of this order, annexing all
materials in support of their claim. The District Magistrate is requested to get the petitioners’ entitlement determined afresh after taking note of the materials placed by the petitioners before the third respondent. Such decision would be taken within a period of four months. With the above observation/direction, this petition stands disposed of.
