The present application under Section 528 of B.N.S.S. has been filed by the applicant with a prayer to issue a direction to Principal Judge, Family Court, Ballia, to recover the maintenance amount from the opposite party no. 2 in Maintenance Case No. 169 of 2022, arising out of an application under Section 128 of Cr.P.C. in pursuance of order dated 13.1.2022 passed by Principal Judge, Family Court, Ballia, in Case No. 604 of 2020, under Section 125 of Cr.P.C. After some arguments, learned counsel for the applicants does not want to press the present application. In view of above, the present application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
