Ramanan (insane), who got compulsory retirement in the third respondent, including gratuity, EPF Employee's Contribution, encashment of earned/sick leave, pension, arrears of salary and other retirement benefits, together with 18% interest per annum, within a time frame as may be fixed by this Court, without affecting the petitioners' right to claim the balance amounts towards those benefits. 2. The petitioners herein are the sisters of one V.Ramanan, who worked as Assistant Accountant in the respondent Board and was compulsorily retired from service due to his mental condition. It was thereafter that the petitioners herein made a claim for appointing them as guardian of the said Ramanan vide G.W.O.P. No.35 of 2024 on the file of the I Additional District Court, Tirunelveli, under Section 14 of the Rights of 2/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.3134 of 2025 Persons with Disabilities Act, 2016, and the second petitioner herein was appointed as the guardian. It was thereafter that the petitioners herein are stated to have made a claim for release of the terminal benefits of the said Ramanan. As the said benefits were not released, the petitioners have approached this Court by filing this Writ Petition. 3. In response, the third respondent filed a counter affidavit stating that the respondents are ready and willing to disburse the terminal benefits and that it is only for production of documents by the petitioners that the same could not be disbursed. He would further submit that, in case the petitioners submit all the required documents, the amount would be released and credited to the account of the said Ramanan as per the TNEB Rules. Paragraph Nos.8 and 9 of the counter affidavit read as under:- "8. I further submit that after filing this writ application our administrative branch contact the petitioner on 13.02.2025 and 28.02.2025 over phone for submitting the required documents for completing the process in this regard the letter also send to the petitioners dated 13.02.2025 by claiming the documents mentioned in the said letter. For the Phone and letter communication the petitioners also replied that they will come to Trichy on 03.03.2025 and submitting the required documents to our office. Further they aggrieved to 3/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.3134 of 2025 get the pension booklet from the office and got thump impression from the employee Ramanan and will produced the same within 15.03.2025. 9. I further submits that I hereby undertake before this Hon'ble Court if the petitioners produce society No Due Certificate, EE/0 & M/Urban /Trichy No Due Certificate, GPF Form and Pension Book let to my office thereafter within one month I will complete the entire proceedings within the month and disburse the eligibility amount to the said V.Ramanan bank account as per the TNEB rules in force." 4. On the other hand, the learned counsel for the petitioners submits that the petitioners have already submitted the required documents as early as on 13.03.2025. But the respondents have not taken any action for release of the amount. In the absence of any dispute with regard to the entitlement of Mr.V.Ramanan to terminal benefits, this Court does not see any reason to keep this matter pending. 5. Accordingly, this Writ Petition is disposed of, permitting the petitioners to submit all the documents as expeditiously as possible to the respondent Board and, on such submission of documents, the third respondent shall take necessary steps for disbursing the terminal benefits of 4/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.3134 of 2025 Mr.V.Ramanan as per the relevant Rules as expeditiously as possible, preferably within a period of six (6) weeks from the date of submission of the documents by the petitioners.
