2. Heard Sri V. Roopesh Kumar Reddy, learned counsel for the petitioner and learned Additional Public Prosecutor representing the State. 3. Learned counsel for the petitioner would submit that the petitioner is the Accused and is facing trial for the offence under Section 138 of N.I.Act. During pendency of the case, he has filed a petition under Section 45 of the Evidence Act, requesting the Court to send his signature on the subject cheque for compensation to the expert. 4. Learned counsel would further submit that learned Presiding Officer of the Court dismissed the petition on the ground that the photo copy of the document may not be useful for comparison. Learned counsel would submit that his counterpart before the trial court is under misconception has informed the Court that the document is photo copy of the sale deed. In fact, the original document is with the petitioner. 5. Considering the submissions made, the Criminal Petition is disposed of.
However, learned Trial Judge is requested to consider the plea of the petitioner, in case, the petitioner is able to file the original documents containing the contemporaneous assured signatures of the subject cheque for comparison, within ten (10) days from this day before the trial court, failing which the petition shall stands dismissed.
