He further submits that as of now, the respondent has cross the age of superannuation and therefore, there is no question of now operating the decree in favour of the respondent. Hence, the decree itself becomes infructuous and non-executable. Learned AGP has no objection if present second appeal is disposed of. Under the circumstances, present second appeal stands disposed of as having become infructuous. Interim relief, if any, granted earlier stands vacated forthwith.
