Hon’ble Shri Bibhu Datta Guru, Judge Order on Board 13/02/2025 Heard. 1. By the present writ petition, the petitioner is seeking, a direction towards the respondent No. 2 i.e. Commissioner, Surguja Division to conclude the proceedings in Revenue Case No. 202212960100014/A-6 which has been filed by respondent No. 8. The appeal has been filed by respondent No. 8 on 02.12.2022 and the same is still pending before the Court of Commissioner. 2. Learned counsel for the petitioner submits that the appeal has been preferred by respondent No. 8 against the order dated 18.11.2022, passed by the SDO by which the mutation order has been passed in favour of the petitioner, herein. He further submits that the appeal has been filed by the respondent No. 8 and thereafter the record of the lower court has been called, therefore, he prays that necessary directions be issued to the respondent No. 2 for concluding the pending proceedings. 3. Learned State counsel would submit that as the appeal is still pending since 2022, the same will be concluded within a period of 3 months. 4. I have heard learned counsel for the parties and perused the order sheets of the proceedings before the Commissioner, it appears that the appeal has been filed on 02.12.2022 and till date the appeal has not been decided.
Considering the same, respondent No. 2 is directed to decide the appeal within a period of 3 months from today. 3
5. The petitioner is directed to apprise the concerned authorities about the order of this Court. 6. With the aforesaid observation, the petition stands disposed off. Sd/-
