HON'BLE MR. JUSTICE SURAJ GOVINDARAJ ORAL ORDER
1. The petitioner is before this Court seeking for the following reliefs; A. Pass an order / Direction or a writ of mandamus to the respondents to consider the representation of the petitioner vide Annexure-F to H, dtd 26.07.2023 and
08.09.2023. B. Pass an order / Direction to the respondent police to remove the name of the petitioner from the Rowdy Register maintained by the R-5. C. Any other order as this Hon'ble Court deems fit in the circumstances of the case.
2. The grievance of the petitioner is that though all the criminal proceedings which were pending against the petitioner has ended in acquittal or dismissal, the name of the petitioner still continues to be in the

rowdy sheet which had been opened in the year
2019.
3. The submission of learned counsel for the petitioner is that none of those proceedings which form the basis of opening the rowdy sheet continuing the name of the petitioner is required to be deleted from the rowdy sheet.
4. Learned AGA would, however, submits that there is one other proceedings under Section 107 of the erstwhile Cr.P.C, still pending, as such the name of the petitioner has been continued in the rowdy sheet.
5. Having gone through the papers, pending proceedings is a FIR which has been registered by the police station in FIR No.62/2022 on 30.06.2022 under Section 107 of erstwhile Cr.P.C. There is no complainant who has approached the police station for registration of the said complaint. The complaint has been suo motu registered by the police authorities and thereafter, apparently there is no

particular progress or investigation thereon, no charge sheet has been laid in respect thereto. In that view of the matter, all the proceedings which had been filed against the petitioner resulted in acquittal or dismissal, I am of the considered opinion that the name of the petitioner cannot be continued in the rowdy sheet register. As such, I pass the following:
ORDER i. the writ petition is allowed. ii. Mandamus is issued directing the respondents to remove the name of the petitioner from the rowdy sheet register maintained by the police authorities within a period of two weeks from the date of receipt of copy of this order.
