Issue a writ, order or direction in the nature of writ of mandamus the direct the court below i.e. Additional District Magistrate (Finance/ Revenue), District-Bulandshahar to decide the Case No.3431 of 2023 (Computerize Case No.D202311170003431) (Manoj Kumar Gupta Vs. Mohammad Imran) under Section 21 (1) Uttar Pradesh Regulation of Urban Premises Tenancy Act, 2021 within stipulated time as fixed by this Hon'ble Court pending in the Court of Additional District Magistrate (Finance/ Revenue) District-Bulandshahar." 3. Learned counsel for the petitioner submitted that the proceeding under Section 21 (1) of Utter Pradesh Regulation of Urban Premises Tenancy Act, 2021 is pending before Rent Authority since 2023. He placed the provisions contained under the U.P. Act No.16 of 2021 which provides that proceeding should be concluded within 30 to 90 days from the date of initiation of the proceeding but in the instant matter proceeding is pending for last more than one years. He further placed the certified copy of the order-sheet of the pending proceeding, which is annexed as Annexure No.2 to the writ petition in order to demonstrate that case is not proceeding expeditiously. 4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally directing the Rent Authority/ Additional District Magistrate (Finance/ Revenue) Bulandshahar to decide the case No.3431 of 2023 under U.P.Act No. 16 of 2021 expeditiously preferably within a period of 2 months from the date of production of certified copy of this order before him after affording opportunity of hearing to both the parties.
