The present writ petition has been filed for quashing the
order dated 16.11.2022 (Annexure-5 to the writ petition) passed by the Banking Ombudsman whereby the complaint filed by the petitioner to revert his money amounting to Rs.10,00,000/-, inadvertently credited by him in the current bank account of “M/s. Finiscope Consultant” having A/c No. 201003577517 (wrongly written as 20100357717) maintained at IndusInd Bank Limited, R.N. Mukherjee Branch, Kolkata, has been closed under clause 16(2)(a) of the Reserve Bank-Integrated Ombudsman Scheme,

2021 as the said account has been made “debit freeze”.
2. Mr. Pratyush Kumar, learned counsel appearing on behalf of the respondent nos. 6 and 7, refers to paragraph- 5 of the counter affidavit filed on behalf of the said respondents, which reads as under:
“That it is stated and submitted that the petitioner under a mistake wrongly debited a sum of Rs. 10 lakhs from the Saving Bank Account No. 30194505904 on 14.09.2022 standing in the name of the petitioner at the State Bank of India, Sector 1B Branch, Bokaro Steel City and thus wrongly credited the said amount in the IndusInd Bank. The said act was committed by the petitioner and State Bank of India owes no responsibility for the same as apparent from the e- mail of the petitioner to crpc@rbi.org.in with copies to others including State Bank of India. Copy of bank statement of Savings Bank Account No. 30194505904 at SBI & petitioner’s email crpc@rbi.org.in have been annexed as Annexures- A and A/1 to the said counter affidavit.”

Learned counsel appearing on behalf of the respondent nos. 6 and 7 while referring to the impugned order dated 16.11.2022 passed by the Banking Ombudsman, submits that the Bank has also received notice from the Superintendent of Police (CID), Andman & Nicobar to make the wrong beneficiary account of M/s. Finiscople Consultant i.e., A/c. No. 201003577517 maintained at Indusind Bank Limited, R.N. Mukherjee Branch, Kolkata as “debit freeze”. Under the said circumstance, the petitioner may approach the concerned investigating agency in this regard.
4. In view of the aforesaid submission of learned counsel for the respondent nos. 6 and 7, learned counsel for the petitioner prays for withdrawal of the present writ petition with liberty to the petitioner to approach the concerned

court/forum/investigating agency for redressal of his grievance.
5. Considering the said prayer of learned counsel for the petitioner, the writ petition is dismissed as withdrawn with aforesaid liberty.
