Challenge in this writ petition is to the order dated 01.08.2024 (Annexure P/1) passed by respondent No. 4 whereby petitioner has been denied absorption for the post of Aanganbadi Worker. 2 2. Learned counsel for petitioner submits that in an illegal and arbitrary manner, respondent No. 6 has been appointed as Aanganbadi Worker whereas petitioner is fit for appointment on the said post which has not been considered by the respondent authorities. 3. Learned State counsel raises preliminary objection stating that this petition is not maintainable as petitioner is having alternate remedy available under law which she has not availed. 4. On the objection raised by learned State counsel, at this stage, learned counsel for petitioner seeks permission of this Court to withdraw this writ petition. However, the concerned authority may be directed to decide the appeal to be filed by petitioner within specified time frame. 5. In view of the submission made by learned counsel for petitioner, this writ petition is dismissed as withdrawn. 6. However, if the appeal is filed by petitioner before concerned Collector within two weeks, the Collector is directed to decide the appeal in accordance with law and pass appropriate orders with in a further period of 45 days.
