2. Petitioner is serving as Assistant Teacher in a Government Junior High School at Chalthi, District Champawat.

According to petitioner, Government Junior High School, Chalthi, District Champawat is categorised as ‘sugam’, whereas Government Intermediate College, Chalthi, which is also running from same campus, was categorised as ‘durgam’ till 2018 and thereafter, its category was changed as ‘sugam’. This, according to petitioner is arbitrary and unacceptable.

Learned State Counsel, however, submits that teachers serving in Government Primary and Government Junior High Schools have a District-level cadre, therefore, a school which is categorised as sugam for them, can be categorised as durgam for persons serving as Lecturer, who have a State-level cadre and they can be posted at places like Dehradun city, Haridwar city or Haldwani city.

5. State counsel further submits that sugam and durgam are relative concepts and not absolute, therefore, place A can be sugam for one person and durgam for some other person. Learned State Counsel points out that petitioner has made representation and has sought writ of mandamus to the competent authority to take decision on his representation, therefore, writ petition can be disposed of with direction to Chief Education Officer, Champawat to take decision on the representation submitted by petitioner.

Learned counsel for the petitioner submits that petitioner be permitted to make fresh representation.
7. Accordingly, writ petition is disposed of with liberty to petitioner to make fresh representation to Chief Education Officer, District Champawat within two weeks from today. If petitioner makes such representation within the stipulated time, decision thereupon shall be taken by Chief Education Officer, Champawat within six months thereafter.
