Heard the parties.
The petitioners have been made accused in connection with Bhelwaghati P.S. Case No. 25 of 2020, for the offence registered under Section 365 of the Indian Penal Code, subsequently added Sections 120(B)/302/201/34 of the Indian Penal Code, pending in the court of Ms. Smriti Tripathy, learned Judicial Magistrate, 1st class, Giridih.
The brother of the informant went missing since 23.08.2020. During the course of investigation, it transpired that the brother of the informant was having illicit relationship with co-accused Radhika Devi. Radhika Devi was arrested and she confessed her guilt and named these petitioners and co-accused persons to be involved in the murder of the brother of the informant.
Learned counsel for the petitioners has submitted that apart from confession, there is no material against the petitioners on record. It was further submitted that similarly situated co-accused persons namely Kuldeep Ray and Radhika Devi have been granted bail by this Court earlier.
Mr. P. D. Agrawal, learned Spl.P.P. on behalf of the State has submitted that Radhika Devi had faced separate trial and she was convicted in the trial.
Considering the nature of allegation, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of Ms. Smriti Tripathy, learned Judicial Magistrate, 1st class, Giridih, or her successor, in connection with Bhelwaghati P.S. Case No. 25 of 2020.
