Heard learned counsel for the petitioners and Sri Saurabh Tiwari,learned counsel for respondent no.4-Nagar Palika Parishad. 2. The petitioners by means of the present writ petition has prayed for the following relief:- "i) Issue a writ, order or direction in the nature of mandamus directing the Respondent No. 2 & 4 not to demolish the house/shop of the Petitioners, situated in Tehsil Sambhal, District Sambhal; ii) Issue any other writ, order or direction which this Hon'ble court may deem fit any proper in the interest of justice otherwise Petitioners shall suffer irreparable loss and injury which cannot be compensated in any terms of way; iii) Award the cost of petition in favour of the Petitioners against the respondents." 3. Sri Saurabh Tiwari, learned counsel for the respondent no.4 on instructions, which is taken on record, states that no action for demolition of petitioners' shop is being taken. He on instructions states that in case Nagar Nigam, who is to demolish any encroachment, would act in accordance with Section 211 of the Nagar Palika Parishad Adhiniyam, 1916. Paragraph no.5 of the instructions is reproduced herein-below:- "5- यह कक जनकहत कक दकषगतत नगर ककत समभल मम जजम कक समसयज समजप करनक हकतत नगर पजललकज पररषद, समभल दजरज अपनक ककतजनतगरत सडकक व नजलज- नजललयक सक अववध अकतकमण हटजनक कक ललए सथल कचननहतत कर, मतनजदद, वदकडययगजफक एवव लजउडसपदकर सक पचजर व पसजर करजनक कक पशजतत नगर पजललकज अलधकनयम, 1916 कक धजरज-211 कक अनतगरत सडकक एवव नजलज- नजललयक सक अववध अकतकमण हटजनक कक समबनध मम नयकटस कनगरत ककयक जजनक कक उपरजनतत हद अववध अकतकमणक कय हटजयज जजतज हव।" 4. In view of the instruction, extracted above, the writ petition at this stage is pre-mature, and is accordingly, dismissed.
