The petitioner is before this Court seeking for the following reliefs; a. "ISSUE an appropriate writ, order or direction in the nature of certiorari quash the Endorsement issued by the R-5, bearing GSC No. PO1095240600155, dated 30.05.2024, vide Annexure-A and; b. ISSUE an appropriate writ, order or direction in the nature of mandamus and direct the Respondents 2 to 5 to give protection to the petitioner to safeguard his possession in respect of land bearing Sy. No. 13, measuring 2 acres 20 guntas of K Harivesandra Village, Kadaba Hobli, Gubbi Taluk, Tumkur District. c. GRANT such other and further reliefs as this Hon'ble Court deem fit in the facts and circumstances of the case." 2. The grievance of the petitioner is that petitioner had obtained injunction order in O.S. No.91/1973 which - 3 - HC-KAR NC: 2025:KHC:40072 WP No. 19755 of 2024 was confirmed in R.A. No.248/1974 vide order dated 21.01.1975 and on that basis, the petitioner having approached the respondent for police protection against the villagers, police protection has not been granted. 3. I am unable to accept the request of the petitioner firstly on the ground that the injunction order was passed in the year 1975 and the said order cannot now he sought to be implemented by way of police protection. Secondly, the police protection is sought for against the villagers in general and not anybody in particular. If at all the petitioner has any grievance against any particular person, who seeks to interfere with the possession of the petitioner, the petitioner would be required to approach the court of competent jurisdiction, obtain necessary orders of injunction and then approach the jurisdictional police. - 4 - HC-KAR NC: 2025:KHC:40072 WP No. 19755 of 2024 4.
