BEFORE HONOURABLE MR. JUSTICE SOUMITRA SAIKIA ORDER 13.03.2025 Heard Mr. M. Rahman, learned counsel for the petitioner. Also heard Mr. B. Sharma, learned Addl. Public Prosecutor, Assam. This is a second anticipatory bail application filed by the petitioner in connection with Dhula P.S. Case No. 38/2024 under Sections 448/376/511 of the
Page No.# 2/2 IPC. The earlier bail petition stood rejected by an order of this Court vide order dated 31.08.2024 passed in A.B. No. 1401/2024. Subsequent thereto the present bail application has been filed. Today when the matter is called up, it is submitted at the bar that the investigations have been completed and the charge-sheet has in the meantime been filed vide Charge-sheet No. 13/2025 dated 31.01.2025. In that view of the matter, the learned counsel for the petitioner submits that the petitioner be permitted to approach the competent authority before which the charge-sheet has been filed. Accordingly, this anticipatory bail application is closed permitting the petitioner to approach the Court of competent jurisdiction before which the charge-sheet has been filed by the investigating authority. Needless to say when the petitioner approaches the concerned Court, the competent Court will examine the matter and pass appropriate order keeping in view the guidelines rendered by the Apex Court in Siddharth Vs. State of U.P., reported in (2022) 1 SCC 676.
