CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 2 08-10-2025 Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks regular bail in connection with Obra P.S. Case No. 58 of 2025 for the offences registered under Section 30(a) of the Bihar Prohibition & Excise Act.
3. There is recovery of 110 litre illicit liquor from a sack kept on the motorcycle bearing Registration No. BR26L 3583 on which petitioner and another co-accused were riding who fled away from the spot leaving the motorcycle. Local Chaukidar disclosed the name of petitioner and other co- accused.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. On the identification of local Chaukidar his name has transpired in this case. He was not
Patna High Court CR. MISC. No.71615 of 2025(2) dt.08-10-2025 2/2 present on the spot. Petitioner has no concern either with the seized liquor or with the motorcycle. Nothing has been recovered from the conscious possession of the petitioner. There is no independent witness to the seizure-list. Petitioner has two criminal antecedents. He is in custody since 12.06.2025. Petitioner undertakes to co-operate in the trial. Similarly situated co-accused, namely, Chirag Paswan, has been granted anticipatory bail by a Co-ordinate Bench of this Court, vide
order dated 20.06.2025 passed in Cr. Misc. No. 36026 of 2025.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.

Considering the submissions made on behalf of the parties, facts and circumstances of the case and period of custody, let the petitioner, named above, be enlarged on bail upon furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Second, Aurangabad (Bihar) in connection with Obra P.S. Case No. 58 of 2025.
