Petitioners limited prayer in this petition is to direct the trial Court for an expeditious disposal of the trial pending in C.C.No.415/2020.
2. It is submitted that the incident took place on 18.01.2020, the complaint was lodged on 19.01.2020. Chargesheet was filed on 09.02.2020 and plea was recorded on 11.03.2022. However, the trial is still pending and therefore, petitioner’s counsel seeks for a direction to expedite the trial and to conclude the same in a time bound manner by fixing the time limit.
3. Chargesheet is filed against the petitioner for the offence punishable under Section 279 and 304A IPC. It is noticed that the chargesheet was filed in the year 2020 and

plea was recorded in the year 2022. However, the order sheet reveals that the accused has remained absent before the trial Court on several dates and even NBW was issued against him. Hence, it cannot be said that the delay is solely on account of the prosecution. The accused himself has contributed for the delay. Hence, directing the trial Court to conclude the trial in a time bound manner may not be proper, considering the conduct of the accused. However, keeping in view that the plea of the accused was recorded in the year 2022, if the accused cooperate with the trial, learned Magistrate shall expedite the trial and make all endeavour to conclude the same as expeditiously as possible. Petition is disposed of. This order shall be communicated to the trial Court, by the Registry.
