IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No. 14991 of 2024 Sk. Nasim …. Petitioner Mr. S. Ahmed, Advocate -versus- State of Odisha …. Opposite Party Mr. C.R. Swain, AGA CORAM: JUSTICE V. NARASINGH Order No. ORDER 11.12.2025 03. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is seeking pre-arrest bail in connection with G.R. Case No.1087 of 2024 pending on the file of learned J.M.F.C., Nimapara, arising out of Kakatpur P.S. Case No.191 of 2024 for commission of offences punishable under Sections 331(6)/311/109 of BNS, read with Section 25(6)/27 of Arms Act. 3. It is submitted by the learned counsel for the petitioner that the F.I.R. was against unknown persons and the petitioner is being implicated as an accused only because after commission of the alleged offence, the accused persons have escaped in the travera vehicle, which stands in the name of the petitioner. It is further submitted that since the petitioner has no criminal proclivity, he seeks pre-arrest bail. 4. Learned counsel for the State opposes the prayer for bail. 5. This Court perused the statements of the witnesses and more particularly, the seizure list. Taking note of the same, this Court is not persuaded to hold that there is no prima facie material against the petitioner. Hence, this Court is not inclined to entertain the bail application. 6. Accordingly, the ABLAPL stands disposed of. (V. NARASINGH) Judge Soumya Designation: Jr. Stenographer
