JUSTICE RAJNESH OSWAL, JUDGE ORDER 06.05.2026 Learned counsel for the petitioner submits that the petitioner, in terms of SRO 111 of 2016 dated March 31, 2016, had moved a formal application in Form-B for grant of permission for felling Khair trees. He submits that even though the said application was moved on May 30, 2022, but the same continues to remain pending. So much so, he submits that prior to the institution of this petition, the petitioner had even served the respondent-Authorities with a representation dated March 20, 2025. But to no avail. Thus, this petition. Response on behalf of respondent Nos. 5 and 6 has been filed and claim of the petitioner is vehemently denied/disputed. But concededly no formal order has yet been passed by the competent Authority either on the application moved by the petitioner or even on the representation filed by him. After we had heard counsel for the parties at some length, they have reached a consensus: that let the petition be disposed of, at this stage, to enable the respondent-Authorities to examine the pending application as also the representation made by the petitioner and pass appropriate orders. And before any such orders are passed, the petitioner shall also be afforded an opportunity of hearing. Accordingly, the petition is disposed of in terms of the statement made by learned counsel for the parties. This Court is sanguine that the competent Authority shall examine the matter in the right earnest and pass appropriate orders in accordance with law within four weeks from today.
