Mr. Vinod Nautiyal, learned counsel for the applicant. 2. Mr. Pratiroop Pandey, learned A.G.A. with Mr. Pradeep Lohani, learned Brief Holder for the State. 3. The instant anticipatory bail application has been moved by the present applicant on an apprehension based on news published in the social media, particularly in daily newspaper namely Dainik Jagran. 4. Mr. Pratiroop Pandey, learned A.G.A. apprise to this court that open enquiry was ordered by the State Government against the present applicant to be concluded by Vigilance Establishment and the enquiry has been concluded and the Vigilance report has been sent to the Government for seeking sanction for prosecution. He further submits that there is no apprehension of arrest since the enquiry has already been concluded and the report has been sent to the Government. Since there is no apprehension of arrest as per the statement as given by Mr. Pratiroop Pandey, therefore, there is no need to pass any such further order; however, the applicant can avail appropriate remedy as per law. 5. Mr. Vinod Nautiyal, learned counsel for the applicant on the pre-lunch session apprise to this court that serious allegations of corruption were levelled against one Deepak Jain, the General Manager of the department along with the affidavit of one Smt. Leela Bora but no action has been taken though the copy of the complaint was sent to the Vigilance Establishment. The copy of this complaint along with the affidavit was supplied to Mr. Pratiroop Pandey, who on instructions apprise that there is no order for an open enquiry, therefore, the Vigilance Establishment cannot proceed with the enquiry. 2025:UHC:5393 6. Be that as it may if there are certain allegations against the public servant that too through an affidavit and there are sufficient material then the State Government as well as the Vigilance Establishment should enquire about such complaint. It is very surprising that a complaint was made along with the affidavit but no action was taken. 7. In such view of the matter, the State is directed to look into the complaint made against Mr. Deepak Jain, the General Manager, which was filed along with the affidavit and take appropriate decision in this regard positively within three weeks. 8.
