Heard both sides. 3. The present application had been taken out to recall the order, wherein this Hon’ble Court had imposed a punishment for not filing the Statement of Affairs within the time prescribed, on the strength that the Statement of Affairs had been filed in the year 2020. The application to impose punishment for not filing the Statement of Affairs had been taken out in the year 2022 and in that regard, a prayer to direct the respondents to submit the Statement of Affairs were also made. Now, it has been brought to the notice of this Court that the Statement of Affairs had been filed as early as in the year 2020, which is also admitted to by the respondent. This Court had imposed a punishment for not filing the Statement of Affairs, without noting the fact that the Statement of Affairs had been filed in the year 2020. Even though there has been a delay in filing the present Statement of Affairs, as pointed out by the learned Official Liquidator, this Court is of the view that the conduct of the applicant in filing the Statement of Affairs belatedly, but before the application had been taken out by the Official Liquidator, would not warrant the punishment imposed on the ground that the Statement of Affairs has not been filed. https://www.mhc.tn.gov.in/judis COMP.A No. 78 of 2025 __________ Page3 of 4 4. In such view of the matter, the order dated 09.08.2024 stands recalled and and reopened and the present application stands allowed. As a consequence of the Statement of Affairs had already been filed prior to the initiation of the said application, the said application in Comp.A.No.300 of 2022 stands closed.
