For Respondent(s): Sole Respondent-meenakshi Ramesh – No appearance. 1/6 https://www.mhc.tn.gov.in/judis O.P.No.195 of 2025 ORDER This Original Petition has been filed under Section 372 of the Indian Succession Act, 1925, seeking grant of Succession Certificate in favour of the petitioner in respect of her 50% share in the debts and securities belonging to her deceased son, late S. Ramesh. 2. The case of the petitioner is that late S. Ramesh died intestate on 15.01.2021 at Chennai. The petitioner is the mother of the deceased. According to the petitioner, the deceased left behind the petitioner and the respondent, who is the widow of the deceased, as his only Class-I legal heirs. Since the deceased had no children, the petitioner and the respondent are each entitled to half share in the estate left behind by the deceased. 3. The aggregate value of the estate is Rs.68,58,852.92 and the petitioner’s 50% share is valued at Rs.34,29,426.46. 4. Notice was ordered to the respondent. The private notice sent by Registered Post was returned with the endorsement “No such person”. Thereafter, substituted service by way of publication was ordered and publication was effected in the 2/6 https://www.mhc.tn.gov.in/judis O.P.No.195 of 2025 Tamil daily “Dinakural” on 29.01.2026. Despite such publication, the respondent has not entered appearance and has not filed any objection. 5. Before the learned master, the petitioner examined herself as P.W.1 and marked the death certificate of the deceased as Ex.P1, the legal heir certificate as Ex.P2, the Axis Bank statement as Ex.P3, the LIC annuity statement as Ex.P4, the Provident Fund statement as Ex.P5 and the Provident Fund passbook as Ex.P6. A certificate under Section 63(4) and (5) of the Bharatiya Sakshya Adhiniyam, 2023. 6. Ex.P1 proves that late S. Ramesh died on 15.01.2021 at Chennai. The materials on record also show that the deceased was ordinarily residing within the jurisdiction of this Court. The petitioner has produced Exs.P3 to P6 to show the debts and securities left behind by the deceased. Hence, the requirements under Sections 371 and 372 of the Indian Succession Act, 1925, are satisfied. 7. Although Ex.P2 legal heir certificate produced by the petitioner mentions only the petitioner, however the petitioner has submitted that the respondent is the widow of the deceased and that both of them are the only Class-I legal heirs. 3/6 https://www.mhc.tn.gov.in/judis O.P.No.195 of 2025 8. This Court is satisfied that there is no impediment under Section 370 of the Indian Succession Act, 1925, for grant of Succession Certificate to the petitioner to the extent of her 50% share. 9. Accordingly, this Original Petition is allowed. Succession Certificate shall be issued in favour of the petitioner in respect of her 50% share in the debts and securities belonging to late S. Ramesh, more fully described in the schedules to the petition, enabling her to collect the said share together with accrued interest, if any. No order as to costs.
