Learned counsel for the petitioner would submit that the petitioner and the respondent nos. 4 and 5 are the daughters of late Shri Ramesh Kumar Batra. After the death of his first wife, Shri Ramesh Kumar Batra had married the respondent no.3, Munni Devi, who had 3 sons already from her first marriage. After the death of late Ramesh Kumar Batra, the respondent no.3, Munni Devi, somehow obtained survivorship certificate in her name and in the name of her two sons born from the first husband. An application for cancellation of the survivorship certificate is already pending. The petitioner has given a representation to the respondent no.2/Executive Officer, Nagar Panchayat, Lalkuan, District Nainital, (Annexure No.1 to the writ petition), so that the property may not be mutated in the name of the respondent no.3 and her sons born from the first marriage. Learned counsel for the petitioner would submit that the respondent no.2/Executive Officer, Nagar Panchayat, Lalkuan, District Nainital may be directed to decide the representation, Annexure No.1 to the writ petition, within a stipulated time. The petition has yet not been admitted. This Court is of the view that the petition may be disposed of with the directions to the respondent no.2/Executive Officer, Nagar Panchayat, Lalkuan, District Nainital to decide the representation, Annexure No.1 to the writ petition, given by the petitioner, in a stipulated time. The petition is disposed of with the directions to the respondent no.2/Executive Officer, Nagar Panchayat, Lalkuan, District Nainital, to decide the representation given by the petitioner, Annexure No.1 to the writ petition, within a period of six weeks from the date of receipt of certified copy of this order.
