No.29345 of 2025 2. The present writ petition is filed praying for a writ of mandamus to direct respondent to cause immediate action on the petitioner's representation dated 16.05.2025 within a time frame that may be fixed by this Court. 3. At the outset, it was submitted by learned Government Advocate that the writ petition itself is misconceived inasmuch as the request in the representation dated 16.05.2025 made by petitioner before the Inspector General of Registration is to quash the rejection check slips dated 13.05.2025 and to register General Powers of Attorney dated 07.04.2025. The relevant of the representation is extracted hereunder: "I state that the procedure followed by the SRO Kundrathur is in order and the two different view taken by the Sub-Registrar Nanueri and Sub- Registrar Thirungurankudi is devoid of merit and born out of lack of understanding of law and therefore their decision is wrong and caused considerable damage and inconvenience to the registrant. Therefore, I request you to consider the circumstances under which the rejection slip has been given by the two Sub-Registrar and to quash the same and instruct them to do the rightful act of entertaining the presentation of the document of General Power of Attorney under the Property Jurisdiction and pass necessary orders on the same as expeditiously as possible." 2/5 https://www.mhc.tn.gov.in/judis W.P. No.29345 of 2025 4. Learned Government Advocate would further submit that if the petitioner is aggrieved by the said refusals, they ought to have challenged the refusal check slips. 5. At this stage, learned counsel for the petitioner would submit that they may be granted liberty to put forth his explanation/objection to the reasons set out in the refusal check slips before the Sub Registrars and request that the above explanation/objection that may be put forth by the petitioner to the reasons set out in the refusal check slips be considered and appropriate orders passed after affording the petitioner an opportunity of hearing, which was agreed to by learned Government Advocate for respondent. 6. It is open to the petitioner to put forth his explanation/objection to the reasons set out in the refusal check slips before the Sub Registrar, Nanguneri and Sub Registrar, Thirugurankudi. If any such explanation/objection are filed, the Sub Registrars shall consider the same and proceed to register the General Powers of Attorney, if it is otherwise in order, in accordance with law, after affording a reasonable opportunity of hearing to petitioner. If, for any reason, the Sub Registrars are of the view that the registration ought to be refused, they would do so after assigning reasons, which was agreed to by the learned counsel 3/5 https://www.mhc.tn.gov.in/judis W.P. No.29345 of 2025 for the petitioner. 6. Accordingly, the writ petition stands disposed of.
