Momo appearing through video conferencing in the proceeding of CONT. CAS(C) No. 32 of 2024. The learned counsel appearing for the petitioner seeks a short accommodation. Whereas, the learned senior counsel namely, Mr. N. Ibotombi appears for the respondents No. 3 and Mr. Juno Rahman, learned counsel appears for the respondents No. 1 & 2 before this Court physically. In the present contempt proceeding in CONT. CAS(C) No. 32 of 2024, the learned senior counsel appearing for the respondent No. 3 submits that order of the Ld. No. 47 of 2023 which is pending before the Ld. Division Bench and therefore, there is no consequence for consideration of relief as sought for in the contempt proceeding which is initiated against the respondents under the provision of Section 2(b) of the Contempt of Court’s Act, 1971. Keeping in view of the status of the writ appeal pending for consideration of the order of the Ld. Single Judge, it is deemed appropriate that the contempt proceeding is hereby disposed of for the presently. However, liberty is granted to the learned counsel appearing for the petitioner for consideration of a fresh contempt proceeding after disposal of the pending writ appeal. Accordingly, the present proceeding is hereby disposed of. Consequent upon the disposal of the main proceeding in CONT.
