JUSTICE KHATIM REZA ORAL ORDER 2 08-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends arrest in connection with Uchkagaon P.S. Case No. 152 of 2025 dated 08.05.2025, registered for the offence punishable under Sections 126(2), 115(2), 64, 62 and 109 of the Bharatiya Nyaya Sanhita, 2023. 3. The prosecution case, in short, is that on the alleged date of occurrence when the sister-in-law of the informant was returning home from sangeet ceremony, the petitioner attempted to outrage her modesty and when she protested, the petitioner assaulted her with bricks on the face and chest due to which she became unconscious. 4. Learned counsel for the petitioner submits that the Patna High Court CR. MISC. No.70842 of 2025(2) dt.08-10-2025 2/3 petitioner is innocent and he has been falsely implicated in this case. It is submitted that as per prosecution case, the occurrence took place on 04.05.2025 but the F.I.R. has been lodged on 08.05.2025 which was perused by the A.C.J.M on 13.05.2025. It is submitted that as a matter of fact the informant went to the house of the accused for borrowing money a week ago but the petitioner refused the same, however, despite refusal, the informant insisted him for money for which the petitioner pushed him out of his house which annoyed him and he felt insulted. It is further submitted that on the date and time of occurrence while injured Urmila Devi was returning home from sangeet ceremony, she was surrounded by stray dogs and in order to save herself she fell down several times on hard surface and sustained injuries. It is also submitted that the alleged occurrence had taken place in the late night. Further, it is submitted that as per the prosecution case, the victim was examined in the hospital but no F.I.R. was lodged at that time and after four days, the present case was lodged. Lastly, it has been submitted that he has no criminal antecedent. 5. Learned A.P.P. has opposed the prayer for bail of the petitioner. 6. Having considered the facts and circumstances of Patna High Court CR. MISC. No.70842 of 2025(2) dt.08-10-2025 3/3 the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Uchkagaon P.S. Case No. 152 of 2025, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Gopalganj, subject to condition as laid down under Section 482(2) of B.N.S.S.. prabhat/- (Khatim Reza, J) U T
