1. In this petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023, prayer is for grant of anticipatory bail to the petitioner in case bearing FIR No. 60 dated 28.03.2025 registered under Sections 115(2), 85 of Bharatiya Nyaya Sanhita, 2023, Police Station Sadar Dhuri, District Sangrur. This is the first petition for anticipatory bail.
2. Complainant Kiranjit Kaur has alleged in the FIR that she was married with Beant Singh, on 21.10.2008 according to Sikh customs and three children were born out of the wedlock. Her husband had been thrashing her for long without any reason, on small pretexts. On 25/26.03.2025, her sister-Kiranjit Kaur called her in the middle of night to inquire about her health and on that account, her husband pulled her hair, slapped, punched her and dragged her by her hair. He thrashed her with a pan and hit her legs, right knee and arm, put his fingers in her mouth and opened it forcibly. CRM-M-37722-2025 (O&M) -2- who rescued her and at night, her brother took her to her parental home. The next day i.e. on 26.03.2025, she was admitted by her brother in Civil Hospital, Sangrur for treatment.

Learned counsel for the petitioner inter alia argued that the marriage was 16 years 09 months old and the complainant herself conceded that the petitioner thrashed her without any reason. He further submitted that no incident, as alleged, ever took place. In fact, petitioner had given a loan of Rs. 1,00,000/- to sister of the complainant and when he asked her to return the money, the false complaint was lodged to exert pressure upon him. He further argued that all the injuries were simple in nature and the petitioner had clean antecedents.
4. Mr. Atul Kumar, Advocate has put in appearance on behalf of complainant and filed his power of attorney. Same is taken on record.
5. Learned State counsel filed reply by way of affidavit of Daman Bir Singh, PPS, Superintendent of Police, Sub Division, Dhuri, District Sangrur. He, assisted by learned counsel for the complainant argued that custodial interrogation of the petitioner was necessary to effect recovery of weapon of offence. Referring to the medico-legal report of the victim, he submitted that 08 injuries were inflicted on her person and specific role was attributed to the petitioner.
6. The rival parties are husband and wife, who have three children. The marriage is 16 years old. The injuries, allegedly inflicted, are simple in nature. Antecedents of the petitioner are clean. He has roots in the society and there is no apprehension expressed that he will evade the process of law. Petitioner is ready and willing to join the investigation.

6. In these circumstances, but without commenting on the merits of the case, the petition is allowed. In the event of arrest, the petitioner shall be released on anticipatory bail subject to his furnishing personal and surety bonds to the satisfaction of the Arresting/Investigating Officer. He shall join investigation as and when called upon to do so and shall abide by the conditions as envisaged under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
