1. This petition under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed for extension of time to deposit the fine amount of Rs. 5000/- as per order dated 14.10.2024 passed by this Court in CR.R. No. 926/2015.

This Court, vide order dated 14.10.2024, while partly allowing the revision petition and sentencing the petitioner to the period already undergone, had enhanced the fine amount of Rs. 2000/- to Rs. 5000 and had granted one month’s time from the date of passing of the order for KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 depositing the enhanced fine amount.
3. Earlier on one occasion also this Court had granted extension of time for compliance of the order dated 14.10.2024.

Learned counsel for the petitioner submits that the petitioner has executed an afÏdavit and it is stated that he is driver of the truck and went to Ahmadabad (Gujrat State) for unloading and during that period, suddenly he was suffering from illness and he was admitted in the hospital for treatment and hence he could not come in the native place and not deposited the fine amount within stipulated time. Hence, he prays for last opportunity that the time period for depositing the fine amount may be extended.

Learned counsel for the other side has no objection.
6. The prayer made by the petitioner appears to be reasonable. Hence, the petitioner is granted further a week’s and no more time from today to deposit the enhanced fine amount as was ordered by this Court on 14.10.2024 in Cr.R. No. 962 of 2015, failing which he shall be taken into custody forthwith.
7. Accordingly, this Cr.M.P. stands disposed of.
8. Registry is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/-
