Supplementary affidavit and counter affidavit filed today are taken on record. Sri Amit Kumar Srivastava, learned counsel for the applicants, Sri Anshul Pathak, learned counsel for the opposite party no. 2 and learned A.G.A. for the State are present. The present application u/s 528 of B.N.S.S. has been filed with prayer to quash the order dated 28.5.2025 passed by Sessions Judge, Prayagraj in Criminal Revision No. 781 of 2024, whereby revisional court affirmed the order dated 3.1.2024 passed in Complaint Case No. 46 of 2020 by A.C.J.M., Court No. 3, Prayagraj, by which learned Magistrate took cognizance under Sections 323, 504, 506 of I.P.C., P.S. Bara, District Prayagraj. Learned counsel for the applicants submits fairly admits that incident took place between both the parties on 1.7.2019 and complainant side is facing trial. After some arguments, learned counsel for the applicants does not want to press the present application. In view of above, the present application is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction.
