Satyen Vaidya, Judge (Oral) Learned counsel for the petitioner has submitted that an identical issue, as is involved in the instant petition, stands decided by a coordinate Bench of this Court on 30.09.2019 in case titled Uttam Singh vs. State of Himacal Pradesh & others in CWP No.1640 of 2017. The said judgment is also stated to have been upheld by a Division Bench of this Court by dismissing LPA No.27 of 2020, titled Secretary, Language, Art & Culture to the Government of Himachal Pradesh & another vs. Shri 2 Uttam Singh & others on 30.05.2024. He further submits that the petitioner will be satisfied, at this stage, in case respondents No.3 and 4 are directed to take a decision in the matter of petitioner, strictly in terms of the judgment in Uttam Singh’s case (supra) within time bound manner. 2. Prayer being innocuous, is not opposed. 3. Accordingly, the petition is disposed of with direction to respondents No.3 and 4 to consider the case of the petitioner strictly in light of the judgment rendered by coordinate Bench of this Court on 30.09.2019 in case titled Uttam Singh vs. State of Himacal Pradesh & others in CWP No.1640 of 2017 within a period of eight weeks from today by passing a detailed and reasoned order. It is further directed that in case the petitioner is found similarly situated to the petitioner in CWP No.1640 of 2017, he shall also be granted all the benefits, as have been made available to the petitioner in aforesaid CWP No.1640 of 2017. 4.
