Thus, feeling aggrieved, petitioner has approached this Court challenging the order dated 10.05.2025 passed by learned trial court, whereby notice was issued to the defendants. 3. Since the order impugned is strictly as per the provision contained in Rule 3 Order 39 of CPC, therefore, the same cannot be faulted. 4. The writ petition is, however, disposed of with a request to learned trial court to consider petitioner’s prayer for temporary injunction on the next date fixed, provided all the defendants are served.
