HC-KAR NC: 2025:KHC:37952 WP No. 13004 of 2024
THIS WP IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO DIRECTING THE RESPONDENT AUTHORITIES TO PLACE IT BEFORE THE AUTHORITY FOR RECTIFICATION AND ISSUE OF CORRECT EXTENT OF LAND IN OCCUPATION AND ENJOYMENT BY THE PETITIONER AND ETC.,
THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE R DEVDAS
ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents.
2. The grievance of petitioner is that there is a mistake in the order passed by the Land Tribunal at Annexure-B in proceedings bearing No.LRF(INA)272/1980- 81 dated 20.09.1982 inasmuch as the extent of land where occupancy rights are conferred in favour of Smt.Thippakka W/o Muthappa (wrongly shown as Smt.Thimmakka W/o Muthappa) is to an extent of 1 acre 14 guntas instead of 2 acres. In that regard, the petitioner

HC-KAR NC: 2025:KHC:37952 WP No. 13004 of 2024
has approached the Tahsildar, Yelahanka Taluk, to seek rectification and the Tahsildar has issued the impugned endorsement at Annexure-D dated 29.12.2023 that it is not within the powers of the Tahsildar to make such a correction, and therefore he has granted liberty to the petitioner to approach the competent authority.
3. This Court does not see any infirmity in the endorsement issued by the Thasildar. The order at Annexure-B is passed by the Land Tribunal and therefore it is only the Land Tribunal which can correct or modify the
order. If it is the contention of the petitioner that the land tribunal does not exist as of date, then the petitioner may either approach the Appellate Authority or any other Competent Authority in terms of the amended provisions of the Karnataka Land Reforms Act, 1966. With these observations, the writ petition stands disposed of.
