This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.303/2024 registered at Police Station – Koshir, District- Sarangarh Bilaigarh (C.G.) for the offence punishable under Sections 318(4), 338, 336(3) and 61(2) of Bharatiya Nyaya Sanhita, 2023. 2. The prosecution story, in brief, is that the applicant is a computer operator at Gatadih society, purchased 272 packets of paddy instead of the authorized 181 packets in the name of Ganpat Jangde, a co- accused. The transaction was facilitated by Krishi Vistar Adhikari Smt. Priti Chandra's biometric presence and a paddy receiving receipt prepared by Suresh Bhardwaj, who is authorized to prepare such ABHIGYA SAXENA Digitally signed by ABHIGYA SAXENA Date: 2025.02.10 18:55:10 +0530 2 receipts. The main accused, Priti Chandra and Ganpat Jangde, allegedly transferred Rs. 83,000 into Ganpat Jangde's account. However, it is claimed that the applicant was not involved in any misconduct. Hence, this bail application under Section 482 of the BNSS for grant of anticipatory bail to the present applicant under the following grounds. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is submitted that the co-accused persons have already been granted anticipatory bail by this Court vide order dated 31.01.2025, 08.01.2025 and 15.01.2025 passed in MCRCA Nos.164/2025, 15/2025 and 70/2025 respectively, therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submits that the applicant is not entitled to be granted anticipatory bail by this Court. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation leveled against the applicant and the fact that the co- accused persons have already been granted anticipatory bail by this Court vide order dated 31.01.2025, 08.01.2025 and 15.01.2025 passed in MCRCA Nos.164/2025, 15/2025 and 70/2025 respectively, hence, this Court is of the view that the applicant is entitled to be granted anticipatory bail in this case. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Aman Kumar Lahre on executing a personal bond with one surety in the like sum to the satisfaction of the arresting OfÏcer, he shall be released on bail on the following conditions:- 3 (a) The Applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such fact to the Court. (b) The Applicants shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicants shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d)The Applicants and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
