Heard the parties.
The petitioners have been made accused in connection with Latehar P.S. Case No. 109 of 2024, corresponding to G.R. Case No.96 of 2025, for the offence registered under Sections 307, 386/34 of the Indian Penal Code, 27 /35 of the Arms Act and Section 17 of the CLA Act, pending in the court of learned Chief Judicial Magistrate, Latehar.
On 28.06.2024 at about 11:40 p.m., the informant was getting coal, loaded on a hywa bearing registration No. JH01FF-9694, when three unknown persons started firing indiscriminately on the informant and other persons.
It appears that one Alok Sao sustained firearm injury on his thigh.
It was submitted that petitioners are not named in the F.I.R. It was further submitted that the names of the petitioners have come in the confession of co-accused.
Learned A.P.P on behalf of the State has opposed the prayer for bail but does not dispute the aforesaid fact.
In view of the submission made above, I am inclined to release the petitioners, on bail. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Latehar, in connection with Latehar P.S. Case No. 109 of 2024, corresponding to G.R. Case No.96 of 2025.
